Terms of use
The archive is provided as a public-interest historical record. It is not an official government record, and it is not evidence.
Acceptance
By accessing sunshinearchive.org you agree to these terms. If you do not agree, do not use the site. These terms are between you and Sunshine Archive LLC, a Florida limited liability company ("we", "us").
What this archive is, and is not
It is not an official record. Sunshine Archive is an independent, privately operated archive. It is not affiliated with, endorsed by, or acting on behalf of the State of Florida or any agency, county, municipality, court, or school district whose pages it records.
It is not evidence, and it is not certified. We make no representation that any snapshot is a complete, accurate, or authenticated reproduction of what a page displayed at a given moment. Rendering varies by browser, timing, and network conditions. Pages built from scripts may capture partially. If you need an authenticated record for a legal proceeding, obtain it from the agency of record through a public-records request.
It is not legal advice. Nothing here interprets what a change to a government page means, legally or otherwise.
No warranty
THE SITE AND ALL ARCHIVED MATERIAL ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the archive is complete, that captures are accurate, that the service will be uninterrupted, or that defects will be corrected.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNSHINE ARCHIVE LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF OR RELIANCE ON THIS SITE OR ANY ARCHIVED MATERIAL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limitations above apply to the greatest extent permitted.
Copyright and the status of archived material
Florida government works. We treat the works of Florida state and local government bodies as public records. This posture is specific to Florida and we do not extend it to other jurisdictions.
Other material. Where a source is not a Florida government work — for example a news organization — we publish only a limited excerpt showing what changed, for the purpose of reporting and commentary on the change itself. We do not republish articles.
This site. The design, code, and original text of sunshinearchive.org are ours.
If you believe we have the status of particular material wrong, write to us before assuming we will not agree with you.
Copyright complaints
If you believe archived material infringes your copyright, write to social@sunshinearchive.org with the URL, the work you claim is infringed, your contact information, and a statement of your good-faith belief that the use is unauthorized. We review every complaint promptly.
For clarity: this archive does not host user-submitted material. Material here is collected by our own crawler, so notice-and-takedown under 17 U.S.C. §512 is offered as a matter of practice and good faith, not as a claim of safe-harbor status for material we ourselves chose to collect.
Removal requests
If archived material concerns you and you believe it should not remain public — for example a page that briefly exposed personal information before an agency corrected it — write to us with the URL and a short explanation.
We read every request and take them seriously. We may remove, redact, or restrict access to material at our sole discretion. We do not guarantee removal, and nothing in these terms creates a right to have material removed. An archive that could be edited on demand by the parties it records would not be an archive.
Acceptable use
- Do not request pages at a rate that degrades the service for others. If you want the data in bulk, write to us — we would rather give you a dump than have you crawl us.
- Do not represent archived material as an official or certified government record.
- Do not use the archive to harass, stalk, or threaten any person, or to assemble dossiers on individuals.
- Do not attempt to gain unauthorized access to the site or its infrastructure.
Our crawling practices
Our crawler is anonymous and unauthenticated, makes only requests that read and never any
that change the state of a system it visits, obeys robots.txt including
Crawl-delay, identifies itself honestly in its user-agent, and does not attempt to
evade bot protection. Full detail, and instructions for limiting or blocking it, are on the
crawler page.
Changes to these terms
We may update these terms. Material changes will be reflected in the date below. Continued use after a change means you accept the revised terms.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these terms or your use of the site will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction there.
If any provision of these terms is held unenforceable, the remainder stays in effect.
